1. Agreement to these terms
These Terms of Use form a binding agreement between you and MOVA. By accessing the website, creating an account, or choosing a paid service, you agree to these terms and to the policies linked from them. If you do not agree, do not use the service.
Additional terms presented at checkout, during a clinical intake, or by a participating provider or pharmacy also apply to the relevant service. If a specific transaction notice conflicts with these terms, the more specific notice controls for that transaction.
2. Eligibility and availability
You must be at least 18 years old and legally able to enter into a contract. Services are available only in jurisdictions where the relevant clinicians, pharmacies, and services are legally available. Availability may depend on your physical location, provider licensure, clinical eligibility, pharmacy coverage, product availability, and applicable law.
You must provide accurate, current information and promptly correct material errors. You may not use another person’s identity, account, prescription, or payment method without lawful authorization.
3. MOVA, clinicians, and pharmacies
MOVA provides technology, coordination, education, checkout, and support services. When clinical care is available, licensed healthcare professionals make independent decisions about diagnosis, treatment, and prescribing.
Clinical services, when offered, are provided by participating licensed healthcare providers and their medical practices. Those professionals are responsible for their own clinical judgment. Prescriptions and medication fulfillment may be handled by participating pharmacies and fulfillment partners under separate professional and pharmacy obligations.
4. Not for emergencies
MOVA is not an emergency service. Do not use the website, chat, WhatsApp, email, or a scheduled telehealth visit for an emergency. If you believe you may have a medical emergency, call 911 or your local emergency number immediately. For urgent symptoms, seek in-person care without waiting for a response from MOVA.
5. Clinical review and prescriptions
Completing an assessment, paying a fee, or requesting a medication does not guarantee a diagnosis, treatment plan, prescription, refill, particular drug, dose, insurance approval, or health outcome. A licensed healthcare professional must decide whether care is appropriate based on the information available and applicable standards of care.
You are responsible for disclosing accurate health history, current medications, allergies, pregnancy status when relevant, and material changes in your condition. Follow the instructions supplied by your clinician and pharmacy and seek care promptly for severe or unexpected symptoms.
6. Telehealth and location
Before receiving remote clinical care, you must review the Telehealth Informed Consent. You may be asked to confirm your identity and physical location at each visit so the provider can determine whether they may lawfully treat you.
7. Medications, labs, and fulfillment
The price displayed at checkout applies to the identified product order. Other clinical, laboratory, pharmacy, or shipping costs apply only when they are separately disclosed before authorization. Prices, insurance coverage, savings eligibility, pharmacy availability, shipping times, and refill timing can change. Do not stop, start, split, share, or change the dose of a prescription without appropriate clinical guidance.
Orders may be fulfilled by participating pharmacies and fulfillment partners. A pharmacy may require additional information, substitute an equivalent presentation when permitted, delay or decline fulfillment, or contact the prescriber before dispensing.
8. Product orders, billing, refunds, and cancellation
Before authorizing a charge, review the product, introductory price, any future or refill price, delivery terms, cancellation terms, and refund policy shown at checkout. MOVA will not charge recurring product orders unless recurring billing is clearly disclosed and separately authorized. You authorize authorized third-party payment processors to charge the payment method you provide only for the amounts and timing disclosed at checkout.
You may cancel an eligible order before fulfillment begins through the support methods made available by MOVA. Cancellation does not automatically refund charges already incurred, except where required by law or stated at checkout.
Charges for completed clinical evaluations, fulfilled product orders, or other services already provided are generally non-refundable, except where required by law. Any different refund terms presented at checkout or in an order-specific notice will control.
9. Electronic communications
You consent to receive records, notices, and transactional communications electronically. Optional marketing or WhatsApp communications require the separate choices shown during intake and may be withdrawn without affecting eligibility for care. Electronic communications can carry privacy and delivery risks; do not use ordinary messaging for emergencies.
10. Acceptable use
You may not:
- interfere with security, access controls, or service operation;
- upload malicious code or attempt unauthorized access;
- misrepresent identity, eligibility, health, or payment information;
- resell, divert, share, or misuse prescription products;
- copy or exploit website content except as permitted by law.
11. Third-party services
The service may link to or depend on clinicians, pharmacies, payment processors, communication platforms, laboratories, carriers, and other third parties. Their own terms and privacy notices may apply. MOVA does not control third-party systems and is not responsible for an independent third party’s acts except to the extent required by law.
12. Intellectual property
The website, software, design, trademarks, text, graphics, and other materials are owned by or licensed to MOVA. These terms grant a limited, personal, revocable, non-transferable right to use the service for its intended purpose. No other license is granted.
13. Disclaimers and liability
Educational website content is general information and is not a substitute for individualized medical advice. Results vary. To the fullest extent permitted by law, non-clinical website services are provided “as is” and “as available,” without a promise that every feature will always be uninterrupted or error-free.
Nothing in these terms excludes rights or liabilities that cannot legally be excluded, including applicable professional duties of a healthcare provider. To the extent permitted by law, MOVA is not liable for indirect, incidental, special, consequential, or punitive damages arising from non-clinical website use.
14. Suspension and termination
Access may be suspended or terminated to protect users, comply with law, address fraud or misuse, or maintain service security. Ending website access does not erase payment obligations already incurred or prevent a provider from retaining medical records as required by law.
15. Governing law and changes
These terms are governed by the laws that apply to the MOVA operating entity and your location, without limiting mandatory consumer or patient protections that apply where you live. MOVA may update these terms prospectively and will post a revised effective date. Material changes may also be presented through the service before they apply.
